Eleven Year Neighbour Dispute to End in the Auction Room

Thursday, May 20th, 2010

A long-running row between two Leigh-on-Sea neighbours will finally be resolved at a Dedman Gray Auction sale on Wednesday 26 May 2010.glenbervie-drive-44

It was 1999 when Milica Markos first took her then neighbour Alan Goodfellow to court over a boundary dispute. At the time, the judge ruled he had wrongly demolished her fence and built a concrete driveway on her land in Glenbervie Drive but ordered Ms. Markos to pay the legal costs, which were in the region of £10,000.

She failed to pay. A court order was made requiring the property to be sold to cover the court costs but again, Markos ignored it. This led to a writ of possession for the four-bedroomed house. Despite a challenge from her legal team, this latest ruling was recently upheld by the Court of Appeal in London.

44 Glenbervie Drive, Leigh-on-Sea will now be sold by auction in Dedman Gray’s sale taking place at 3pm on Wednesday 26 May at Saxon Hall, Aviation Way, Southend-on-Sea.

The property has a guide price of £80,000.

Dedman Gray Auction’s Managing Director Mike Gray says “We have already received a high number of enquiries about this particular lot.  We are unaware of the full background on how this situation originally occurred and then escalated, but we do have confirmation - in the form of a Court Order - that the property must be sold on the day of the auction.”

He added “In circumstances like these, an auction sale is the best method of selling. Auctions offer both vendors and buyers quick, simple and cost-effective solutions and consequently, are becoming an increasingly popular, tried and trusted way to buy and sell property.”
